Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Suvedita Ambashtha, an individual developer based in India who operates OmniStudy (“OmniStudy”, “we”, “us”, “our”). They cover the OmniStudy app for Android and the website at https://www.omnistudyai.com (together, the “Service”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy (https://www.omnistudyai.com/legal/privacy). If you do not agree, do not use the Service. Nothing in these Terms takes away rights you have under consumer law that cannot be excluded by contract.

1. Who can use OmniStudy

You must be at least 13 years old.
If you are under 18, or under the age of majority where you live, you may use OmniStudy only with the permission of a parent or legal guardian. They accept these Terms on your behalf and are responsible for your use of the Service, including any purchases.
You may not use OmniStudy if the law prohibits you from doing so.

2. The Service

OmniStudy is an AI study app. It turns topics, notes and documents into live classes, notes, flashcards, quizzes, mind maps, timelines, podcasts and study plans, answers your questions, and tracks your progress. It is a study aid. It supports teachers, textbooks and professional advice but does not replace them.

We keep improving OmniStudy, so features, limits and content can change. If a change significantly reduces what a paid plan includes during a period you have already paid for, we will tell you in advance. You may then cancel and, where the law requires, receive a refund for the unused part.

3. Your account

Give accurate information and keep it up to date. If you sign up with an email address and password, you must verify the email address before you can sign in.
Keep your password safe. You are responsible for what happens in your account. Tell us straight away if you think someone else has used it.
Your account is for you alone. Do not share, sell or transfer it.

4. Plans, subscriptions and payments

OmniStudy has a free plan with monthly limits, and paid plans (currently Learner Pro and Omni Expert), billed monthly or yearly. What each plan includes, and its price in your currency, are shown before you buy.

Buying in the Android app (Google Play)

Subscriptions bought in the Android app are sold and billed by Google Play and are also governed by the Google Play Terms of Service. Taxes are shown or added as Google Play displays them.
Your subscription renews automatically at the end of each billing period (monthly or yearly), and Google Play charges your payment method at the price then in effect, until you cancel.
Free trials: if a plan offers a free trial, the length of the trial and the price you will pay afterwards are shown before you start. You are not charged if you cancel before the trial ends. If you do not cancel, the trial turns into a paid subscription automatically and you are charged when it ends. Each person may use a free trial once, and Google Play may apply its own eligibility rules.
Upgrades, downgrades and other plan changes are processed by Google Play, which may apply them immediately or at your next renewal and adjusts the charge accordingly.
If the price of your subscription increases, Google Play tells you beforehand and, where required, asks you to accept the new price. If you do not accept it, your subscription ends at the end of the current period.

Buying on the website

Plans bought on the website are billed by our payment processor, Dodo Payments, in the currency shown at checkout. They renew automatically at the end of each period until you cancel.
We give you at least 30 days’ notice before a price change applies to your plan, and you can cancel before it does.

You manage a subscription where you bought it: a Google Play subscription in Google Play, and a website subscription on the website. Your plan works in both the app and on the website when you sign in to the same account.

5. Cancelling

Google Play subscriptions

In the Google Play Store app, tap your profile picture → Payments & subscriptions → Subscriptions → OmniStudy → Cancel subscription. You can also get there from OmniStudy (Profile → Settings → Billing → Manage subscription) or at https://play.google.com/store/account/subscriptions
Uninstalling the app or deleting your OmniStudy account does not cancel a Google Play subscription.

Website subscriptions

Cancel from Settings on the website. Deleting your account also stops future renewals.

After you cancel, you keep your paid features until the end of the period you have paid for and are not charged again. Your account then moves to the free plan.

6. Refunds

Purchases made through Google Play

Refunds for Google Play purchases follow Google Play’s refund policies. Within 48 hours of a purchase you can ask Google for a refund directly, from your Google Play order history or Google’s refund request page.
After 48 hours, email suvedita7@gmail.com with your Google Play order number (it starts with “GPA.”). We will review your request and can issue refunds through Google Play in the cases below, and whenever the law requires.

Purchases made on the website

Email suvedita7@gmail.com with your account email, the transaction ID and the reason. Approved refunds are processed within 5–7 business days.

We refund, wherever you bought:

Duplicate charges for the same period.
A charge made after you cancelled in time.
Paid features that were unavailable for more than 48 hours in a row because of a fault on our side.
Any other case where the consumer law of your country gives you a refund.

Usually not refunded:

The rest of a billing period after you cancel. You keep access until it ends instead.
A renewal you did not cancel in time, once you have used paid features in the new period.

Right of withdrawal (EU, EEA and UK consumers)

You can withdraw from a subscription within 14 days of buying it by emailing us, without giving a reason.
Because paid features start as soon as you subscribe, by subscribing you ask us to begin during those 14 days. If you withdraw, you pay only for the part of the service you received before withdrawing, and we refund the rest. If you have not used any paid features, you get a full refund.

7. AI-generated content

OmniStudy uses artificial intelligence (Google Gemini) to generate content. AI can be inaccurate, incomplete, outdated or biased, and can sound confident when it is wrong.
Check important information against reliable sources before you rely on it, especially for exams. Never rely on OmniStudy for medical, legal, financial or safety decisions.
AI output is generated for you and may be similar to output generated for other people.
We use safeguards to prevent harmful output, but they are not perfect. If you see content that is offensive, harmful or wrong, please report it (see “Reporting content”).

8. Academic integrity

Use OmniStudy to learn, not to cheat. Do not use it in exams or graded work where AI help is not allowed, and follow your school’s or university’s rules.
Do not present AI-generated work as your own where that is not allowed, and cite it where your institution requires.

You are responsible for how you use what OmniStudy generates.

9. Acceptable use

Do not use OmniStudy to create, upload or share content that:

sexualises minors, or exploits or endangers children in any way (we report this to the authorities);
is sexually explicit, or promotes violence, terrorism, self-harm or suicide;
harasses, bullies or threatens anyone, or promotes hatred against people because of who they are;
is illegal, or helps someone commit a crime or cause harm, for example instructions for weapons, drugs or malware;
deceives people, for example by impersonating a real person, forging documents, or spreading false information;
infringes anyone’s copyright, trademark, privacy or other rights, or contains another person’s personal data without their permission.

Do not:

try to get around usage limits, payments or safety filters, including by creating extra accounts;
use bots, scrapers or other automated means to access the Service, or overload or disrupt it;
copy, modify, reverse engineer or resell the Service, except where the law allows;
access other people’s accounts or data, or test or break our security;
use the Service to build a competing product or to train AI models.

We may remove content, limit features, or suspend or close accounts that break these rules, and we report illegal content to the authorities where required.

10. Reporting content

You can report AI-generated content without leaving the app: Profile → Settings → Help → Report AI content. You can also email suvedita7@gmail.com. We review every report, act on it where needed, and use reports to improve our safeguards. For a copyright complaint, tell us which work is affected, where it appears, and how to contact you.

11. Your content and ours

You keep ownership of what you upload. You give us a worldwide, non-exclusive, royalty-free licence to store, copy, process and transmit it, including to our AI providers, only as needed to provide the Service to you. The licence ends when you delete the content or your account, except for copies the law requires us to keep.
Only upload material you have the right to use.
As long as you follow these Terms, you may use the study material OmniStudy generates for you for your own personal, educational and non-commercial purposes.
OmniStudy itself (the app, the website, their design, software and brand, and our own materials) belongs to us and our licensors. We give you a personal, non-transferable and revocable licence to use the app as intended while you follow these Terms.
If you send us feedback or ideas, we may use them without any obligation to you.

12. Other companies’ services

OmniStudy relies on services provided by other companies, including Google Play, Google Sign-In, Google Cloud and Firebase, Google Gemini, RevenueCat and our payment processor. Your use of Google Play and your Google account is also governed by Google’s terms. We are not responsible for services we do not control.

13. Suspension and termination

You can stop using OmniStudy and delete your account at any time.
We may suspend or close your account, or limit your access, if you seriously or repeatedly break these Terms, if the law requires it, or to protect other users or the Service. Where reasonable, we will tell you why and let you respond first.
If we close your account when you have not broken these Terms, we will refund the unused part of any subscription you paid for in advance.
If we ever stop offering the Service, we will give you reasonable notice and refund the unused part of any prepaid subscription.
Terms that by their nature should continue after your account ends (such as the disclaimers, limitation of liability and governing law) continue to apply.

14. Disclaimers

To the extent the law allows, the Service is provided “as is” and “as available”. We do not promise that it will be uninterrupted, error-free or always available, that AI output will be accurate, or that using OmniStudy will lead to any particular grade or result. Some countries do not allow these exclusions, so some of them may not apply to you.

15. Limitation of liability

To the maximum extent permitted by law, we are not liable for:

your academic performance or grades;
indirect, incidental, special, consequential or punitive losses;
errors, omissions or inaccuracies in AI-generated content;
interruptions caused by third-party providers or network outages.

Our total liability to you for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim and (b) USD 50.

Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, gross negligence or wilful misconduct, or any other liability that cannot be limited by law.

16. Responsibility for misuse

If you use OmniStudy in breach of these Terms or the law, or upload content that infringes someone else’s rights, you are responsible for the resulting claims and costs, to the extent the law allows. This does not apply to consumers where local law does not permit it.

17. Consumer rights

If you are a consumer and the law where you live gives you rights that cannot be waived by contract, those rights prevail over anything in these Terms. That includes statutory guarantees and refund rights under EU consumer law, the UK Consumer Rights Act 2015, India’s Consumer Protection Act 2019, Brazil’s Consumer Defence Code, and US state laws.

18. Governing law and disputes

If you have a problem, please contact us first at suvedita7@gmail.com. We acknowledge complaints within 48 hours and aim to resolve them within one month.

These Terms are governed by the laws of India. Disputes that are not subject to mandatory consumer-law jurisdiction will be resolved exclusively by the courts of Chennai, India. Consumers in India may also approach the consumer commissions under the Consumer Protection Act, 2019.

If you are a consumer in the EU, EEA or UK, you keep the protection of the mandatory consumer law of the country where you live, and you may bring proceedings in the courts of that country.

19. Changes to these Terms

We may update these Terms, for example for new features or changes in the law. For important changes we will tell you in the app or by email at least 15 days before they take effect, unless the law requires a change sooner. If you keep using OmniStudy after the changes take effect, the updated Terms apply. If you do not agree, stop using OmniStudy and cancel your subscription before they take effect.

20. General

These Terms, our Privacy Policy, our Cookie Policy and any terms shown when you buy a plan form the whole agreement between you and us about the Service.
If any part of these Terms cannot be enforced, the rest still applies.
If we do not enforce a right straight away, we can still enforce it later.
We may transfer our rights and obligations under these Terms to anyone who takes over OmniStudy; this will not reduce your rights. You may not transfer yours without our consent.
We are not responsible for delays or failures caused by events beyond our reasonable control.
If these Terms are translated, the English version prevails to the extent the law allows.
