Welcome to OmniStudy (“OmniStudy,” “we,” “us,” or “our”). By accessing or using our platform at https://www.omnistudyai.com, you agree to these Terms. If you do not agree, please discontinue use. These Terms apply worldwide; where the law of your country grants you stronger consumer protections than these Terms, those protections prevail.
1. Description of Service
OmniStudy is an AI-powered SaaS learning platform designed as a “Cerebral Partner” to help users understand and master complex subjects.
Features include:
- AI-generated podcasts, flashcards, quizzes, and mind maps
- AI study partner and doubt-solving tools
- Live AI classes and learning assistance
OmniStudy is intended for supplemental learning only.
2. Academic Integrity & Responsible Use
You agree to use OmniStudy ethically:
- Do not use the platform to cheat in exams or graded assessments
- Do not submit AI-generated content as your own without proper citation
- Always verify AI-generated outputs with reliable academic sources
You are solely responsible for complying with your institution’s policies.
3. Accounts & Security
- You are responsible for maintaining account confidentiality
- All activity under your account is your responsibility
- Sharing accounts across multiple users is prohibited
4. Subscriptions, Payments & Billing
- OmniStudy operates on a subscription-based model with monthly and yearly plans, plus a free Basic tier.
- Payments are processed by Dodo Payments, a PCI-DSS compliant provider; we never see or store your full card details.
- By subscribing you authorize recurring billing on the cadence you chose (monthly or yearly). The charge happens automatically at the start of each cycle until you cancel.
- Prices are listed in USD and may include applicable taxes depending on your country.
- We will give you at least 30 days’ notice before any price change takes effect on your plan; you can cancel before the change applies.
5. Cancellation Policy
- You may cancel anytime via your dashboard
- Cancellation prevents future billing
- Access continues until the end of the billing cycle (unless stated otherwise)
6. Refund Policy
Due to the per-generation AI compute costs we pay, refunds outside the cases below are limited.
Eligible for a refund:
- Platform downtime that prevented you from using paid features for more than 48 consecutive hours.
- Duplicate charges for the same billing period.
- A valid promotional or money-back guarantee we explicitly published.
Not eligible:
- Partial usage of services during the billing period.
- Missing a cancellation deadline before automatic renewal — set a calendar reminder or cancel from your dashboard.
- Disappointment with academic performance outcomes — these depend on your study habits, not the tool.
How to request a refund — email suvedita7@gmail.com with:
- Account email
- Transaction ID
- Reason for the request
Approved refunds are processed within 5–7 business days.
Right of withdrawal (EU / UK consumers)
- If you are a consumer based in the EU, UK, or EEA, you have a statutory 14-day right of withdrawal for digital services under Directive 2011/83/EU.
- OmniStudy delivers AI generations the moment you click "Generate" after subscribing — that is digital content supplied immediately. By starting any paid generation within the 14-day window you expressly request immediate performance and acknowledge that you lose your right of withdrawal once that performance begins.
- If you have not used any paid generations during the 14-day window, you can request a full refund by emailing the address above; we will process it within 14 days of receiving your request.
7. AI-Generated Content Disclaimer
- AI may produce inaccurate or incomplete results (“hallucinations”)
- OmniStudy does not guarantee correctness or academic outcomes
- You must independently verify all generated content
8. Acceptable Use
You agree NOT to:
- Use bots or scripts to exploit the platform
- Attempt to bypass limits or safeguards
- Generate harmful, illegal, or restricted content
- Reverse-engineer or misuse the system
Violation may result in account suspension.
9. Intellectual Property
- You retain ownership of your uploaded content
- You grant OmniStudy permission to process it for service functionality
- AI-generated outputs are for personal, non-commercial use
- All platform assets belong to OmniStudy
10. Consumer rights
Where you are a consumer in a jurisdiction whose laws grant you mandatory rights that cannot be waived by contract — including statutory warranties, refund rights under EU consumer law, or your rights under CCPA/CPRA, the UK Consumer Rights Act, India’s Consumer Protection Act, and Brazil’s Código de Defesa do Consumidor — those rights take precedence over anything in these Terms. Nothing here limits or excludes a right we are not legally allowed to limit.
11. Limitation of Liability
To the maximum extent permitted by applicable law, OmniStudy is not liable for:
- Academic performance or grades.
- Indirect, incidental, special, consequential, or punitive damages.
- Errors, omissions, or hallucinations in AI-generated content.
- Service interruptions caused by third-party providers (Google Cloud, payment processors, network outages).
Our total aggregate liability to you for any claim arising out of or relating to the service is capped at the greater of (a) the amount you paid us in the 12 months immediately preceding the claim, or (b) USD 50. This cap does not apply to liability we are not legally allowed to limit (gross negligence, wilful misconduct, death or personal injury, statutory consumer rights).
12. Governing Law
These Terms are governed by the laws of India, and disputes that are not subject to mandatory consumer law jurisdiction will be resolved exclusively by the courts of Chennai, India.
If you are a consumer in the EU, UK, or EEA, this choice of law does not deprive you of the protection of the mandatory consumer law of your country of habitual residence; you retain the right to bring proceedings in the courts of that country, and any consumer-protection provision of that country that is more favourable to you than these Terms will apply.
13. Changes to Terms
We may update these Terms at any time. Continued use of the platform implies acceptance.
